Terms of Service

1. Eligibility

You must be at least 13 years of age to use TrackMyPaw. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these requirements.

2. Account Registration

To use TrackMyPaw, you must create an account using an email address and password or Sign in with Apple. You are responsible for:

• Providing accurate and current information
• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account

You may not create multiple accounts, impersonate another person, or use another user's account without permission.

2.1 Your Dogs

You can add one or more dogs to a single account and choose which dog or dogs join each walk. Each dog has its own profile and its own leaderboard standing.

3. Subscriptions and Payments

3.1 Free Use and TrackMyPaw Pro

Free use. You may create an account and use TrackMyPaw at no charge. Free accounts can record up to five (5) walks in total (lifetime, across all dogs on your account).

TrackMyPaw Pro. After your five free walks, you will be prompted to subscribe to TrackMyPaw Pro in order to record additional walks. TrackMyPaw Pro unlocks unlimited walk recording. All other features of the App — including viewing your walk journal and past walks, your profile, dog profiles, photos you have already saved, statistics, streaks, weather history, and the leaderboard — remain fully available to free users without a subscription.

The exact subscription title, length of each billing period, and price are displayed in the App before purchase and are also visible in your Apple Subscriptions settings. We may also offer an introductory free trial; if offered, the length of the trial and the price that applies after the trial are shown on the paywall before you confirm the subscription.

3.2 Billing

• Payment is charged to your Apple ID account at the confirmation of purchase.
• Your subscription automatically renews for the same period at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Prices are shown inclusive of applicable taxes where required.

3.3 Managing Your Subscription

You can view, manage, and cancel your subscription, and turn off auto-renewal, at any time in your device's Account Settings (Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current paid period; no partial refunds are issued for unused portions. You may also restore previous purchases within the App from the Paywall screen.

3.4 Free Trials

We may offer a free trial to eligible new subscribers. If you do not cancel at least 24 hours before the trial ends, the trial will automatically convert into a paid subscription and your Apple ID will be charged the applicable subscription fee. Any unused portion of a free trial is forfeited when you purchase a subscription.

3.5 Refunds

All purchases are processed by Apple. Refund requests must be submitted to Apple in accordance with their refund policy. We are not able to issue refunds directly.

3.6 Changes to Subscription Pricing

We may change subscription prices from time to time. If a price change affects your subscription, we will notify you through the App or through Apple in accordance with Apple's requirements, and you will be given the opportunity to cancel before the change takes effect.

4. Acceptable Use

You agree not to use TrackMyPaw to:

• Upload, share, or display content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Upload photos that depict violence, nudity, hate speech, or content that exploits minors
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Interfere with or disrupt the App, its servers, or connected networks
• Attempt to gain unauthorised access to other users' accounts or data
• Use the App for any commercial purpose not expressly permitted
• Manipulate leaderboard rankings through fraudulent activity, automated tools, or any form of cheating
• Harvest or collect information about other users without their consent

We reserve the right to remove content and suspend or terminate accounts that violate these Terms, at our sole discretion.

5. User-Generated Content

5.1 Your Content

You retain ownership of any photos, text, or other content you upload to TrackMyPaw ("Your Content"). By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute Your Content solely for the purpose of operating and improving the App (for example, displaying your walk photos in your journal or your profile photo on the leaderboard).

5.2 Content Standards

You are solely responsible for Your Content. You represent that you have the right to upload it and that it does not violate the Acceptable Use rules above or any applicable law.

5.3 Content Moderation

Proactive filtering. Dog names are checked against a list of slurs, sexual terms, and other objectionable language at the moment you submit them. Entries that match are rejected before they are saved or shown on the leaderboard.

Reporting and blocking. You can report another user directly from the leaderboard by tapping the "…" menu next to their entry and choosing Report. You can also Block a user from the same menu to stop seeing them on your leaderboard. Alternatively, you may email us at trackmypaw.team@gmail.com to report content or behaviour that violates these Terms.

Review turnaround. We review reported content and take appropriate action, which may include removal of the content and suspension or termination of the offending account. We aim to review reports within 24 hours, though complex cases may take longer. We have zero tolerance for objectionable content or abusive users.

6. Leaderboards and Public Features

By using the leaderboard feature, you understand and agree that each of your dogs' names, breeds, photos, and walk statistics (distance, XP, walk count) will be visible to all other authenticated TrackMyPaw users, with each dog ranked as its own leaderboard entry. If you have not set a dog photo, your profile photo is shown on the leaderboard as a fallback. Your display name, walk routes, and walk photos are not shared on the leaderboard.

7. Location Services

TrackMyPaw uses your device's GPS to track walks. You must grant location permission for walk tracking to function. Location data is only collected during active walk sessions that you initiate. You can revoke location permissions at any time in your device settings. For full details, see our Privacy Policy.

8. Account Deletion

You may permanently delete your account at any time from within the App (Profile → Delete Account). Deleting your account will permanently remove all your data, including your profile, dog profiles, walk history, photos, and leaderboard entries. This action cannot be undone.

If you have an active subscription, deleting your account does not automatically cancel your subscription. You must cancel your subscription separately through your device's Account Settings before deleting your account to avoid further charges.

9. Intellectual Property

The App, including its design, code, graphics, logos, and all content other than user-generated content, is the property of TrackMyPaw and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

10. Disclaimers

TrackMyPaw is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The App will be uninterrupted, error-free, or secure
• Walk distance, route, or other measurements will be perfectly accurate
• Weather information will be accurate or current

You use the App at your own risk. Please be aware of your surroundings when walking and always prioritise your safety and the safety of your dog.

11. Limitation of Liability

To the maximum extent permitted by applicable law, TrackMyPaw and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or property damage arising out of or related to your use of the App.

12. Indemnification

You agree to indemnify and hold harmless TrackMyPaw and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.

13. Changes to These Terms

We may modify these Terms at any time. When we do, we will update the "Effective date" at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the App and delete your account.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Ukraine, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the App that cannot be resolved informally shall be submitted to the competent courts of Ukraine, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

Nothing in this section deprives you of any mandatory consumer-protection rights that apply to you under the laws of your country of residence. If you are a consumer resident in the European Economic Area or the United Kingdom, you may also have the right to bring proceedings in the courts of your country of residence, and you may have the right to submit disputes to an online dispute-resolution platform (ec.europa.eu/consumers/odr).

15. Apple App Store — Additional Terms

The following terms apply because you downloaded the App from the Apple App Store. They are required by Apple Inc. ("Apple") and supplement the rest of these Terms:

1. Acknowledgement. You acknowledge that these Terms are concluded between you and TrackMyPaw only, and not with Apple. TrackMyPaw, not Apple, is solely responsible for the App and its content.
2. Scope of Licence. The licence granted to you for the App is a limited, non-transferable licence to use the App on any Apple-branded product that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
3. Maintenance and Support. TrackMyPaw is solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to provide any maintenance or support services for the App.
4. Warranty. TrackMyPaw is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
5. Product Claims. TrackMyPaw, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation.
6. Intellectual Property Rights. You and TrackMyPaw acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, TrackMyPaw, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual-property-infringement claim.
7. Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist-supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Developer Name and Address. For questions, complaints, or claims with respect to the App, please contact TrackMyPaw at trackmypaw.team@gmail.com.
9. Third-Party Terms of Agreement. You must comply with any applicable third-party terms of agreement when using the App (for example, your wireless-data-services agreement).
10. Third-Party Beneficiary. You and TrackMyPaw acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary hereof.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
